Complaint Cites Irregularities by Warrick County Commission and Cites Violations of Federal and State Law

The National Waste and Recycling Association (NWRA) today filed an action in the United States District Court for the Southern District of Indiana against the Warrick County Solid Waste Management District on behalf of its member companies doing business in Warrick County, Indiana.

In its complaint, NWRA seeks injunctive relief to stop the award of a de facto monopoly for the processing of waste and recycling in Warrick County.  The complaint alleges that the award resulted from a highly irregular bidding and procurement process conducted by the Warrick County Commission.  NWRA details in its complaint that the recently enacted process followed by the Warrick County Solid Waste Management District violates both the Commerce Clause of the United States Constitution and various Indiana statutes.
